Theft by Deception

Protecting Your Rights When Accused of Theft by Deception

Theft by deception is a serious criminal offense in Pennsylvania. These charges involve allegations that someone intentionally misled or deceived another person to take money, property, or services. Even a single accusation can result in severe penalties, a permanent criminal record, and long-term damage to your reputation.

At Sheridan Lawyers, we aggressively defend clients charged with theft by deception in Chester County, Bucks County, Delaware County, and Montgomery County. We know how to challenge complex financial evidence and protect your future.

What Is Theft by Deception?

Under 18 Pa.C.S. § 3922, a person commits theft by deception if they intentionally obtain property of another by creating or reinforcing a false impression, such as:

  • Misrepresenting facts about a transaction

  • Making false promises with no intent to perform

  • Concealing or failing to correct information that leads another person to transfer property

  • Using any other form of deception to gain money, property, or services

Common examples include:

  • Accepting payment for goods or services that were never delivered

  • Falsifying information to gain access to funds or property

  • Misrepresenting the ownership or value of items being sold

Penalties for Theft by Deception

Penalties depend on the value of the property involved:

  • Under $50: Summary offense

  • $50 to under $2,000: Misdemeanor (possible jail time)

  • $2,000 or more: Felony, with penalties up to 7 years in prison

If the deception involves a firearm, motor vehicle, fiduciary responsibility, or involves a victim over 60 years old, the grading and penalties can be even harsher.

In addition to prison and fines, a conviction can mean:

  • Restitution to the alleged victim

  • A permanent criminal record

  • Immigration and licensing consequences

How Sheridan Lawyers Defends Theft by Deception Cases

These cases are often document-heavy and require careful analysis. Our strategies may include:

  • Demonstrating lack of intent to deceive

  • Proving that the transaction was a misunderstanding or civil dispute, not a crime

  • Challenging financial records, witness statements, and investigative methods

  • Negotiating for dismissal, charge reductions, or entry into diversionary programs like ARD

If necessary, we are prepared to fight for you at trial.

Why You Need an Attorney Immediately

Do not try to explain your side of the story to investigators without legal counsel. In theft by deception cases, what you say can be misinterpreted and used against you. Early representation is critical to protecting your rights.
