Penalties for Criminal Mischief

Penalties depend on the value of the damage caused:

  • Less than $500: Summary offense (up to 90 days in jail and fines)

  • $500 to $1,000: Misdemeanor of the third degree (up to 1 year in jail)

  • $1,000 to $5,000: Misdemeanor of the second degree (up to 2 years in jail)

  • Over $5,000 or causing danger to human life: Felony (up to 7 years in prison)

In addition, the court may order restitution for the cost of the damage.
